By accessing and using the Casper Portal software, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you are prohibited from using or accessing the Casper Portal services.
Casper Portal provides a comprehensive software platform designed for managing business operations, including customer relationship management, communication tools, AI-powered services, and more. These services are provided on a subscription basis, with additional charges based on usage.
Subject to your compliance with these Terms, Casper Portal grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the software strictly for your internal business purposes. This license is subject to the following conditions:
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify Casper Portal immediately of any unauthorized access or use of your account.
Casper Portal and its trusted third-party partners may require access to your accounts or systems to perform necessary services. By providing such access, you authorize Casper Portal and its partners to take actions necessary for service fulfillment, including but not limited to system integration, data management, and troubleshooting.
Casper Portal is committed to protecting your privacy. We handle your personal data in accordance with all applicable data protection laws, including GDPR and CCPA where applicable. Data collected during the provision of services will be used solely for delivering the agreed-upon services and improving the software. Casper Portal will not share your data with third parties without your consent, except as outlined in this Agreement or as required by law.
Casper Portal uses industry-standard security measures to protect your data. However, you acknowledge and agree that no method of transmission over the Internet, or method of electronic storage, is 100% secure, and Casper Portal cannot guarantee absolute security.
Casper Portal may share your information with trusted third-party vendors and service providers to facilitate service delivery. These third parties are obligated to protect your information and use it solely for the purposes outlined in this Agreement.
By agreeing to these Terms, you consent to Casper Portal sharing your information with third-party vendors as necessary. Casper Portal remains fully responsible for the actions of any third-party vendors it engages.
All intellectual property rights in the Casper Portal software, including but not limited to the code, design, and any accompanying materials, are owned by Casper Portal. You acknowledge that the software and any related content are protected by copyright, trademark, and other intellectual property laws.
Casper Portal grants you no rights or licenses to use any trademarks, service marks, logos, or other branding features of Casper Portal without prior written permission.
All content and data generated within Casper Portal remain your property upon full payment of services. You are granted a non-exclusive, non-transferable license to use the software and any related content for your internal business purposes. Casper Portal reserves the right to showcase anonymized work as part of its portfolio unless you explicitly request otherwise in writing.
Casper Portal services are billed on a recurring basis every 30 days. By subscribing to our services, you authorize Casper Portal to charge the payment method you have provided. Payments are non-refundable, and failure to pay may result in suspension or termination of services.
Any payment not received within 7 days of the due date shall accrue interest at the rate of 1.5% per month or the maximum allowed by law, whichever is lower.
In the event of non-payment, Casper Portal reserves the right to suspend Services until payment is made in full. If payment is not received within 30 days, Casper Portal may terminate this Agreement immediately and pursue legal action to recover outstanding amounts.
Due to the nature of software services, Casper Portal does not offer refunds. Once a payment is processed, it is considered final. By agreeing to these Terms, you acknowledge and accept this policy.
Casper Portal may, from time to time, release updates or patches to improve the software, address security vulnerabilities, or introduce new features. You agree to promptly install such updates as they become available. Casper Portal is not liable for any issues arising from your failure to install updates.
Casper Portal reserves the right to modify, suspend, or terminate its services at any time. Any significant changes will be communicated to you in advance. If you choose to terminate your services, you must provide written notice at least 30 days prior to the end of your current billing cycle.
Casper Portal shall not be liable for any indirect, incidental, or consequential damages arising from the Services provided. Our total liability under this Agreement shall be limited to the amount of fees paid by you in the one month preceding the event giving rise to the liability.
Casper Portal shall not be liable for any delay or failure to perform its obligations under this Agreement if such delay or failure is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, or governmental orders.
You agree to indemnify, defend, and hold harmless Casper Portal, its officers, directors, employees, and agents from any claims, liabilities, or expenses arising out of or in connection with the Services provided, except to the extent caused by Casper Portal's gross negligence or willful misconduct.
These Terms are governed by and construed in accordance with the laws of the State of New Hampshire. Any disputes arising from these Terms will be resolved in the courts of Nashua, New Hampshire.
Neither party shall be liable for any failure or delay in performance under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or governmental actions.
During the term of this Agreement and for one (1) year thereafter, you agree not to directly or indirectly solicit or hire any employee, contractor, or consultant of Casper Portal without prior written consent.
This Agreement may be amended only in writing and signed by both parties. Any modifications to these Terms will be communicated in advance and will require your consent before taking effect.
These Terms constitute the entire agreement between you and Casper Portal and supersede all prior agreements, understandings, and representations, whether oral or written.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
