Please read carefully. By accessing, creating an account for, subscribing to, or using CasperPortal, you agree to be bound by these Terms. If you do not agree, do not use the platform. Use the Print / PDF button above to generate a signature-ready version.

  • "You," "your," "Customer," or "Subscriber" means the individual or entity using the Platform and, where applicable, any entity that individual is binding.
  • "Platform" means the CasperPortal software-as-a-service product, including its CRM, messaging, email, SMS/MMS, voice, automations, workflows, reporting, calendars, forms, websites, funnels, integrations, AI-assisted features, dashboards, APIs, and related software functionality.
  • "Subscription" means your paid right of access to the Platform during an active term.

  • "Terms" means these Terms of Service.

2. Acceptance of Terms

These Terms form a binding agreement between you and CasperPortal. You accept these Terms by accessing the Platform, creating a Subscriber Account, subscribing, paying, logging in, or using the Platform. If you accept on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms. You must be at least 18 years old and legally capable of entering into a binding agreement.

3. Platform Description

CasperPortal is a business software platform that may include CRM tools, messaging, email, SMS/MMS, voice features, automations, workflows, reporting, calendars, forms, websites, funnels, integrations, AI-assisted features, dashboards, and related business operations functionality.

We may add, change, remove, limit, or suspend features at any time. Certain features depend on Third-Party Services and APIs, and the availability or functionality of those features may change without notice.

4. Software Subscription and License

CasperPortal is provided strictly as a software-as-a-service (SaaS) subscription. Subject to your continued compliance with these Terms and timely payment of all applicable fees, CasperPortal grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Platform during an active paid term, solely for your internal business purposes.

You do not own, and acquire no rights in, the Platform software, source code, infrastructure, templates, snapshots, workflows, automations, platform logic, system designs, internal methods, custom-values architecture, database structures, integrations, AI tools, prompts, or phone, email, and domain infrastructure.

You may not, and may not permit any third party to:

  • Copy, modify, reverse engineer, decompile, disassemble, or attempt to derive source code from the Platform;
  • Resell, sublicense, lease, time-share, or otherwise commercially exploit the Platform except as expressly permitted in these Terms or Order Documentation;
  • Build a competing product or service using the Platform, or use the Platform to benchmark for a competing product;
  • Frame, mirror, scrape, or systematically extract data from the Platform other than through documented APIs and within published rate limits;
  • Remove or alter any proprietary notices; or
  • Use the Platform in a manner that exceeds the usage, contact, sending, storage, or seat limits associated with your Subscription tier.

5. Intellectual Property

CasperPortal and its licensors retain all right, title, and interest in and to the Platform, including all software, designs, templates, workflows, automations, frameworks, methods, prompts, AI configurations, documentation, and trademarks. No rights are granted other than those expressly stated in these Terms.

You retain ownership of Customer Data, subject to the licenses you grant in Section 13.

If you provide CasperPortal with feedback, suggestions, or ideas about the Platform, you grant CasperPortal a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation to you.

6. Brand Separation: CasperPortal and CasperB2B

CasperPortal and CasperB2B are separate offerings. CasperPortal is the software platform. CasperB2B is a separate services provider governed by its own terms.

A CasperPortal Subscription does not include done-for-you services, custom website builds, copywriting, design, consulting, implementation, campaign management, project management, migration work, contractor labor, or managed services unless expressly stated in a separate signed written agreement.

Purchasing services from CasperB2B does not create ownership of the CasperPortal Platform, source code, infrastructure, templates, workflows, automations, databases, custom fields, phone numbers, domains, or platform configurations unless expressly stated in a signed written agreement.

7. Account Responsibility and Security

You are solely responsible for all users, sub-accounts, workspaces, contacts, domains, phone numbers, forms, campaigns, automations, integrations, login credentials, user permissions, imported contacts, Customer Data, and all activity under your account, regardless of whether authorized by you.

You agree to:

  • Provide accurate account information and keep it current;
  • Keep credentials confidential and use reasonable security practices, including multi-factor authentication where available;
  • Promptly notify us of any known or suspected unauthorized access through our contact form at /contact or (207) 222-7737; and
  • Be responsible for the acts and omissions of every person who accesses the Platform through your account, including your employees, contractors, and agents.

CasperPortal is not responsible for loss caused by credential sharing, weak passwords, unauthorized users, or third-party account compromise.

8. Backup Duty

You are solely responsible for creating, maintaining, testing, and retaining your own independent backups, exports, copies, screenshots, records, contact lists, campaign records, consent records, websites, pages, automations, forms, workflows, Customer Data, and business-continuity plans.

CasperPortal is not your archive, legal-records system, backup provider, or disaster-recovery provider. Any export tools we make available are provided as a convenience and may change or become unavailable without notice.

9. Portability Disclaimer

CasperPortal does not guarantee that websites, pages, funnels, automations, workflows, templates, forms, custom fields, data structures, contact records, phone numbers, domains, integrations, or configurations are exportable, transferable, reproducible, recoverable, portable, or usable outside CasperPortal or its dependent Third-Party Services. Many features are tightly coupled to the Platform and to vendor systems and have no portable equivalent.

10. Third-Party Services

The Platform relies on Third-Party Services such as hosting providers, CRM infrastructure, SMS/MMS carriers, phone providers, email providers, payment processors, domain registrars, analytics providers, AI providers, third-party APIs, integration partners, and other vendors.

CasperPortal is not responsible for outages, downtime, feature removal, API changes, pricing changes, transfer restrictions, deliverability problems, carrier filtering, email blacklisting, phone-number loss, domain-transfer issues, account bans, policy enforcement, vendor suspensions, or data loss caused by Third-Party Services. Third-Party Services are governed by their own terms, and your use of them is at your own risk. We do not warrant continued compatibility, uptime, import or export support, or continued availability of any Third-Party Service.

11. Acceptable Use

You agree not to use the Platform, and not to permit anyone to use the Platform, in any way that violates applicable law, third-party rules, or these Terms. Prohibited conduct includes:

  • Sending spam, unlawful marketing, or unauthorized communications;
  • Phishing, impersonation, fraud, or deceptive marketing;
  • Distributing malware or malicious code;
  • Facilitating illegal goods, illegal services, or unlawful conduct;
  • Harassment, threats, abuse, or unlawful collection practices;
  • Damaging Platform integrity, deliverability, sender reputation, or carrier relationships;
  • Using AI features in violation of law, third-party rights, or platform rules;
  • Scraping, reverse engineering, or systematically extracting data outside documented APIs and rate limits;
  • Probing or attacking Platform security, attempting unauthorized access, or interfering with other subscribers; and
  • Using the Platform for any business or content category that we determine, in our reasonable discretion, presents elevated regulatory, carrier, deliverability, or reputational risk, including without limitation high-risk financial offers, regulated substances, adult content, gambling content, or politically restricted communications, except as expressly permitted in writing.

We may remove content, disable functions, restrict access, suspend sending capabilities, or terminate Subscriber Accounts that violate these Terms or that we determine, in our reasonable discretion, present platform, security, legal, reputational, deliverability, or operational risk.

12. Messaging, Email, SMS, Voice, and Marketing Compliance

You are solely responsible for all communications you initiate through the Platform, including SMS, MMS, RCS, email, voice calls, voicemail drops, broadcasts, automations, sequences, and contact imports.

You represent and warrant that you will:

  • Obtain and maintain all required notices, opt-ins, and consents (including, where applicable, prior express written consent under the TCPA) before contacting any recipient;
  • Maintain proof of consent and required records for the periods required by law;
  • Comply with all applicable laws, regulations, platform rules, and carrier rules, including the TCPA, CAN-SPAM Act, do-not-call rules, 10DLC and toll-free verification requirements, CTIA messaging principles, state-level mini-TCPA statutes, and equivalent rules in other jurisdictions;
  • Properly register brands, campaigns, and use cases as required by carriers, and provide accurate registration information;
  • Honor opt-outs, unsubscribes, do-not-contact requests, and timing and quiet-hours restrictions;
  • Not send unlawful, deceptive, misleading, or unauthorized messages, and not use the Platform to send communications on behalf of an undisclosed party; and
  • Pay any carrier fines, surcharges, or pass-through fees attributable to your traffic.

CasperPortal does not provide legal advice or compliance certification, and does not warrant that your use of the Platform is lawful in any jurisdiction. You are solely responsible for your messaging compliance posture.

13. Customer Data

You retain your rights in Customer Data, subject to the rights you grant CasperPortal under this section. You grant CasperPortal a worldwide, non-exclusive, royalty-free license to host, process, store, transmit, display, secure, analyze, troubleshoot, back up (for our own operational purposes), aggregate, anonymize, and otherwise use Customer Data as necessary to operate, maintain, and improve the Platform and to provide the Services.

You are responsible for:

  • The legality, accuracy, integrity, and sufficiency of Customer Data;
  • Obtaining all necessary permissions, consents, and notices from your contacts, customers, and users;
  • Providing your own privacy notices and managing retention policies;
  • Responding to data-subject and consumer-rights requests unless otherwise agreed in writing;
  • Adhering to restrictions on regulated data (including health, financial, biometric, and children's data); and
  • Maintaining your own backups and records as required by Section 8.

14. Billing and Fees

Subscriptions are billed on a recurring basis. By subscribing, you authorize CasperPortal to charge the payment method on file in advance for all applicable subscription fees, usage-based charges, third-party pass-through charges (including carrier and messaging fees), and applicable taxes. Subscriptions automatically renew for successive billing periods at the then-current rate unless cancelled before renewal.

Unless otherwise stated in Order Documentation:

  • You are responsible for keeping your payment information current and chargeable;
  • Failed, reversed, or disputed payments may result in immediate restriction or suspension of your account;
  • Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law;
  • You remain responsible for all charges incurred prior to cancellation; and
  • There is no guarantee of pricing permanence unless a signed agreement explicitly states otherwise.

You agree not to initiate a chargeback, payment dispute, or reversal for a charge owed under these Terms or Order Documentation. Improper chargebacks are a material breach of this agreement.

15. Refund Policy

Except where required by law or expressly stated in a signed written agreement, all fees are non-refundable.

There are no refunds for unused time, reduced usage, feature changes, account suspension, cancellation, third-party issues, deliverability problems, your failure to use the Platform, your failure to maintain backups, or dissatisfaction after access was provided.

16. Pricing and Feature Changes

CasperPortal may change pricing, packaging, features, usage limits, support levels, and included functionality for future billing periods, with notice provided by reasonable means (which may include email or in-product notice). Material pricing changes will take effect no earlier than the next renewal of your Subscription. Unless expressly committed in a separate signed agreement, no fixed cap on increases, discount continuation, promotional-pricing continuation, or guaranteed feature retention applies.

If you do not accept a pricing or feature change, your remedy is to cancel before the change takes effect.

17. Suspension and Termination by CasperPortal

CasperPortal may suspend, restrict, disable, remove, refuse, or terminate any Subscriber Account, user, sub-account, workspace, phone number, domain, website, page, form, automation, integration, feature, sending capability, or access right, in whole or in part, at any time, in our reasonable discretion, including for:

  • Nonpayment;
  • Suspected fraud or unauthorized access;
  • Abuse, harassment, or violations of Section 11 (Acceptable Use) or Section 12 (Messaging Compliance);
  • Legal exposure, regulatory action, or third-party enforcement;
  • Reputational, deliverability, or carrier risk;
  • Security or operational risk;
  • Excessive support burden or platform misuse;
  • Material breach of these Terms; or
  • Discontinuation of the Platform or any feature.

You acknowledge that suspension or termination may occur without advance notice, and that you must maintain your own ongoing backups and contingency plans at all times under Section 8.

18. Cancellation by You; Effect of Termination

You may cancel your Subscription through an authorized CasperPortal cancellation channel. Unless otherwise stated in Order Documentation, customer-initiated cancellations apply to future billing periods only and take effect at the end of the then-current billing period. Annual subscriptions are non-cancelable during the active term unless Order Documentation states otherwise.

Upon suspension, restriction, cancellation, expiration, or termination:

  • Your right to access and use the Platform may immediately cease, in whole or in part;
  • We may immediately disable logins, sending capabilities, integrations, domains, numbers, websites, automations, and related access;
  • You are solely responsible for having already exported any Customer Data, communications, contacts, websites, forms, or records you wish to retain;
  • Phone numbers, domains, records, websites, page designs, automations, and Customer Data may become unavailable, unusable, non-transferable, non-portable, or permanently unrecoverable;
  • We may retain, archive, purge, delete, or destroy data in accordance with our policies, operational practices, legal requirements, or third-party limitations;
  • Reactivation, reinstatement, or data recovery, if offered at all, may be subject to fees; and
  • CasperPortal has no obligation to preserve, transfer, rebuild, export, reproduce, migrate, or deliver any website, funnel, automation, workflow, dataset, number, domain, or configuration unless a signed agreement expressly says otherwise.

19. Disclaimer of Warranties

THE PLATFORM AND ALL FEATURES, OUTPUTS, AND RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASPERPORTAL DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE PLATFORM OR ANY FEATURE WILL BE CONTINUOUS, UNINTERRUPTED, SECURE, ERROR-FREE, TRANSFERABLE, OR FIT FOR YOUR PARTICULAR WORKFLOW. WE DO NOT WARRANT THAT ANY COMMUNICATION WILL BE DELIVERED, THAT ANY MESSAGE WILL REACH AN INBOX OR HANDSET, THAT ANY FEATURE WILL CONTINUE TO EXIST, OR THAT ANY CONFIGURATION WILL REMAIN PORTABLE.

No Professional Advice. CasperPortal does not provide legal, compliance, tax, accounting, financial, cybersecurity-certification, medical, insurance, immigration, or regulatory advice.

No Guarantee of Results. CasperPortal does not guarantee leads, sales, revenue, rankings, approvals, deliverability, conversions, uptime, profitability, customer responses, marketing results, business outcomes, or legal compliance.

20. AI Features

The Platform may include artificial-intelligence and machine-learning-assisted features. AI-assisted features may produce output that is inaccurate, incomplete, biased, fabricated, offensive, outdated, legally risky, or otherwise unsuitable for your intended use.

You are solely responsible for reviewing, editing, validating, approving, fact-checking, and legally assessing all AI-generated content before use, publication, distribution, or reliance. You must disclose AI interactions when required by law or platform rules. AI features are not a substitute for professional advice. CasperPortal disclaims all liability for AI-generated content and for any decision you make based on it.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASPERPORTAL AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, WEBSITE VALUE, PORTABILITY VALUE, AD-SPEND LOSS, LEAD LOSS, RANKING LOSS, DELIVERABILITY LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE PLATFORM, ANY THIRD-PARTY SERVICE, OR THESE TERMS, EVEN IF CASPERPORTAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CASPERPORTAL'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE PLATFORM, OR ANY SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CASPERPORTAL DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL ELEMENT OF THE BARGAIN BETWEEN YOU AND CASPERPORTAL AND APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, THE FOREGOING LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

22. Indemnification

You agree to defend, indemnify, and hold harmless CasperPortal and its affiliates, owners, officers, employees, contractors, and service providers from and against any claims, investigations, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform or reliance on any output, including AI output;
  • Customer Data, your content, campaigns, products, services, websites, automations, imports, exports, or integrations;
  • Your violation of these Terms or applicable law;
  • Your failure to obtain required consents, permissions, or notices, including TCPA and CAN-SPAM consent;
  • Your disputes with customers, vendors, users, regulators, carriers, or third parties;
  • Messaging violations, privacy violations, intellectual-property claims, misleading claims, or consent failures;
  • Any carrier fines, penalties, or surcharges attributable to your traffic; or
  • Any claim that Customer Data, your communications, or your use of the Platform infringes, violates, misappropriates, or otherwise harms any right, law, or person.

23. Force Majeure

Neither party will be liable for any failure or delay in performance (other than payment obligations) caused by events beyond its reasonable control, including acts of God, natural disasters, fire, flood, severe weather, pandemic, epidemic, war, civil unrest, terrorism, government action, labor disputes, internet or telecommunications failure, third-party-platform outages, denial-of-service or other cyberattacks, carrier disruptions, or supply-chain disruption. The affected party will use reasonable efforts to resume performance.

24. Dispute Resolution; Binding Arbitration; Class Waiver

Please read this section carefully. It affects how disputes between you and CasperPortal are resolved.

24.1 Informal Resolution. Before initiating any formal proceeding, the parties will attempt to resolve any dispute informally for at least sixty (60) days after written notice of the dispute is delivered under Section 26 (Notices). The notice must describe the dispute and the relief sought.

24.2 Binding Individual Arbitration. If a dispute is not resolved through informal resolution, any dispute, claim, or controversy arising out of or related to these Terms, the Platform, or the relationship between the parties (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or, where applicable, its Consumer Arbitration Rules). The arbitration will be conducted in Hillsborough County, New Hampshire, or remotely by agreement, before a single arbitrator. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

24.3 Class Action Waiver. You and CasperPortal each waive any right to bring or participate in a class action, collective action, mass action, consolidated action, or representative action. Disputes will be resolved only on an individual basis. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this Class Action Waiver is found unenforceable as to any claim or relief sought, that claim or relief must be brought in court and severed from any claim that remains in arbitration; the rest of this Section 24 remains in effect.

24.4 Mass Filings. If twenty-five (25) or more similar arbitration demands are filed by or with the assistance of the same law firm or coordinated counsel within a ninety (90) day period, the parties agree the demands will be administered in sequenced batches of no more than fifty (50) at a time, with the next batch beginning only after the prior batch is resolved, in order to manage cost and administration. The parties will work in good faith with the AAA to implement this provision.

24.5 Carve-Outs. Either party may (a) bring an individual claim in small-claims court if eligible, and (b) seek injunctive or equitable relief in court to protect intellectual property, confidential information, or to enforce Section 4 (License) or Section 11 (Acceptable Use). Filing such a claim does not waive the right to arbitrate other Disputes.

24.6 Opt-Out. You may opt out of this Section 24 by sending written notice through our contact form at /contact or (207) 222-7737 within thirty (30) days of first accepting these Terms. The notice must include your name, the entity you represent (if any), the email associated with your Subscriber Account, and a clear statement that you are opting out of arbitration. Opting out will not affect any other provision of these Terms.

24.7 Survival. This Section 24 survives termination of these Terms.

25. Governing Law and Venue

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For any matter not subject to arbitration under Section 24, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in New Hampshire and waive any objection based on inconvenient forum.

26. Notices

Notices to CasperPortal must be sent in writing through our contact form at /contact or (207) 222-7737 with a copy by mail to CasperPortal, 252 Daniel Webster Hwy #1093, Nashua, NH 03060. Notices to you may be sent to the email address or postal address on file with your Subscriber Account, and you are responsible for keeping that information current. Notices are effective upon delivery to email and three (3) business days after deposit if sent by mail.

27. Electronic Communications and Signatures

You consent to receive communications from CasperPortal electronically, including by email, text, in-app messaging, and posting to our website or platform. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. You agree that electronic signatures, click-through acceptance, and recorded acceptance events have the same force and effect as handwritten signatures.

28. Changes to the Platform and to These Terms

We may change, replace, redesign, repackage, rebrand, remove, or discontinue any part of the Platform, and may impose or revise usage limits, support boundaries, feature-access rules, packaging conditions, or technical requirements at any time. CasperPortal has no obligation to continue offering any particular feature, integration, layout, workflow, pricing structure, website-builder component, AI tool, or related functionality unless expressly stated in a separate written agreement.

We may update these Terms from time to time. Updated Terms become effective when posted with a new "Last Updated" date or on the effective date stated in the revised Terms. Material changes will be communicated by reasonable means, which may include email or in-product notice. Your continued access to or use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

29. Assignment

You may not assign or transfer these Terms or any rights or obligations under them, by operation of law or otherwise, without our prior written consent. CasperPortal may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or to an affiliate, without notice or consent. Any unauthorized assignment is void.

30. No Waiver; Cumulative Remedies

No failure or delay by CasperPortal to exercise any right or remedy is a waiver of that right or remedy. A waiver is effective only if given in writing and signed by an authorized representative of CasperPortal. All rights and remedies are cumulative and not exclusive of any other rights or remedies provided by law or equity.

31. Severability

If any provision of these Terms is found invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

32. Survival

The following sections survive termination or expiration of these Terms: 4 (License) as to obligations and restrictions, 5 (Intellectual Property), 8 (Backup Duty), 9 (Portability Disclaimer), 13 (Customer Data) as to rights granted in data already processed, 14 (Billing) as to amounts owed, 18 (Effect of Termination), 19 (Disclaimer of Warranties), 20 (AI Features) as to disclaimers, 21 (Limitation of Liability), 22 (Indemnification), 24 (Dispute Resolution), 25 (Governing Law and Venue), 26 (Notices), 30 (No Waiver), 31 (Severability), this Section 32, and 33 (Entire Agreement).

33. Entire Agreement; Order of Precedence

These Terms, together with any applicable Order Documentation and the CasperPortal Privacy Policy, constitute the entire agreement between you and CasperPortal regarding the subject matter and supersede all prior or contemporaneous understandings. In the event of a conflict, the order of precedence is: (1) a signed master subscription or services agreement between the parties; (2) signed Order Documentation; (3) these Terms; (4) the Privacy Policy. Section headings are for reference only and do not affect interpretation.
